Terms and Conditions
This agreement is between [Supplier] Walkers Greengrocers and Florists, 19 Hulton Street, Hanley, Stoke-on-Trent ST1 6AU (hereafter known as ‘Walker’s’) and [Customer] whose home address is overleaf (hereafter known as the ‘Client’).
(1). Walkers delivers weekly greengroceries to the preferred address of the Client for as long as the Client requires.
It is agreed as follows:
1. Definitions and interptretations
1.1 “Likes” means those items listed overleaf that the Client has listed to receive in preference to other available produce that week.
1.2 “Dislikes” means those items of produce that the Client has listed overleaf and has elected never to receive.
2. Produce selection
2.1 Walker’s will select produce according to the preferences outlined overleaf. Any items outlined as ‘likes’ will take precedence. Items outlined as ‘dislikes’ will be excluded.
2.2 Weekly produce will be subject to seasonal variation. Where ‘likes’ are not available substitutes will be selected by Walker’s at their discretion.
2.3 The Client is able to write or telephone Walker’s to alter their “likes” and “dislikes” lists. The client must allow 3 days before the next delivery date to be assured that the next delivery will reflect the new preferences.
3.1 Walkers will deliver the produce on the same day each week.
3.2 A safe place to leave the produce must be provided in the event that no one is available at the address to accept the delivery.
3.3 If we are unable to deliver to you, or have to deliver late, for reasons beyond our control, for example adverse weather conditions, strike actions, vehicle breakdown, traffic congestion or supplier failure, we cannot accept liability for any inconvenience or loss that this causes.
3.4 Walker’s will endeavour to keep the delivery date the same. However, Walker’s reserve the right to alter this temporarily or permanently.
Walker’s will inform you if they do.
4.1 The signed mandate overleaf instructs Walkers to use the payment card details listed to debit the weekly payments.
4.2 Walkers will keep all payment card details secure and protect the privacy of every client.
4.3 All payments will be debited as the produce is placed on the van for delivery.
4.4 Where a payment card is declined Walker’s reserve the right to refuse delivery.
4.5 The Client must inform Walker’s of any alterations to their payment card details.
5. 4th Bag Free Offer
5.1 The Client must have paid for three consecutive deliveries until being entitled to the 4th free bag.
5.2 The free bag the Client receives is to the same value of the 3 previous bags. For example, if you have been receiving a standard fruit and veg bag for 3 weeks that is what you will receive on your 4th delivery.
6. Cancellation rights
6.1 The weekly delivery agreement will remain in place beyond the 4th week until the Client informs Walker’s otherwise.
6.2 The client has the right to cancel at anytime by email or letter. Cancellation will take place immediately.
6.3 Walker’s may cancel this agreement by providing 1 month’s notice by email or letter.
6.4 Should the client cancel the weekly deliveries it is the responsibility of the Client to return any recyclable shopping bags to the shop. Non-returned bags will be charged at their usual retail prices and Walker’s will debit the payment card for this amount.
